These Terms of Service ("Terms") govern your use of the websites, online forms, and SMS messaging programs operated by ASAP Fence & Gates ("ASAP," "we," "us," or "our"). By using our websites, submitting a form, or sending or receiving text messages with us, you agree to these Terms. If you do not agree, please do not use our websites or messaging program.

1. Who we are

ASAP Fence & Gates is a Florida-licensed general contractor (License #CBC1266715) operating from 2219 63rd Avenue East, Bradenton, FL and 2215 Griffin Rd, Leesburg, FL. We provide residential and commercial fence and gate installation, repair, and maintenance services throughout Central and Southwest Florida.

2. Use of our websites

You may browse our websites for personal, non-commercial use, and you may submit forms to request quotes, schedule estimates, or contact us. You agree not to:

• Submit false, misleading, or third-party information without authorization.
• Use our forms or messaging to harass, spam, or impersonate anyone.
• Attempt to disrupt, reverse-engineer, scrape, or gain unauthorized access to our websites or systems.
• Use our content (text, images, gallery photos) for commercial purposes without written permission.

3. Quotes, estimates, and contracts

Information you submit through our online forms creates a request for contact only — not a binding contract. All pricing, scope, materials, and timelines for fence or gate work are established in a signed written proposal or contract. Online estimates, AI-generated takeoffs, and verbal quotes are preliminary and subject to on-site verification.

4. SMS messaging program terms

These SMS terms apply when you exchange text messages with ASAP Fence & Gates. They supplement (and are incorporated into) our Privacy Policy.

4.1 Program description

ASAP Fence & Gates operates an SMS/MMS program for transactional and customer-service messages — including estimate confirmations, scheduling and arrival updates, invoices, warranty follow-up, and customer-care replies — and, for recipients who opt in, occasional promotional messages and maintenance-program reminders.

4.2 Consent and opt-in

By submitting your mobile number through our website forms, by phone, in person, or in writing, you give ASAP Fence & Gates express written consent to send you SMS/MMS messages related to your inquiry, project, account, and (where applicable) promotions. Consent is not a condition of any purchase. You represent that the mobile number you provide is yours or that you are authorized to receive messages on it.

4.3 Message frequency

Message frequency varies depending on your interaction with us (active project vs. completed project vs. opted-in marketing list). You will not be sent more than is reasonably necessary to support the service or program you signed up for.

4.4 Message and data rates

Message and data rates may apply to each message sent and received. Check with your wireless carrier for details on your plan.

4.5 Opt-out instructions

You can cancel SMS messages from ASAP Fence & Gates at any time by replying STOP to any of our messages. After you send STOP, we will send a one-time confirmation that you have been unsubscribed, and we will not send further messages from that program unless you opt in again.

4.7 Carrier support and disclaimers

Our SMS program is available on most major U.S. wireless carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages.

4.8 No sharing of mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors and service providers that support our operations is permitted solely so they can perform services on our behalf. All other categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. Intellectual property

All content on our websites — including text, graphics, logos, photographs (including before/after gallery images), AI-generated renderings, and software — is the property of ASAP Fence & Gates or our licensors and is protected by United States and international copyright and trademark laws. You may not copy, distribute, or create derivative works without our written permission.

6. Third-party links and services

Our websites may link to third-party sites (Google reviews, social media, manufacturer pages). We are not responsible for the content, privacy, or practices of any third-party site or service.

7. Disclaimers

Our websites and any AI-assisted tools (estimating, drawing, chat) are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Project pricing, lead times, and material availability are indicative until confirmed in a signed contract.

8. Limitation of liability

To the maximum extent permitted by law, ASAP Fence & Gates and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of our websites, messaging program, or any AI-assisted tools. Our total liability for any claim arising out of website or messaging use will not exceed one hundred U.S. dollars ($100). Liability arising from a signed fence or gate installation contract is governed by that contract.

9. Indemnification

You agree to indemnify and hold harmless ASAP Fence & Gates from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of our websites or messaging program.

10. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of our websites or messaging program will be brought exclusively in the state or federal courts located in Manatee County, Florida, and you consent to personal jurisdiction in those courts.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new Effective date. Continued use of our websites or messaging program after a change constitutes acceptance of the updated Terms.
